The Home Run Jacket draw (the "Draw") is run by the Spark Charity Foundation (the "Foundation"), Charity Registration Number 76805 0429 RR0001. Payments are processed by Zeffy. Zeffy is a payment processor only and is not a sponsor or administrator of the Draw.
The Foundation may require proof of age and residency before releasing the prize. An entrant who cannot provide it forfeits the prize and a replacement winner is drawn.
The Draw opens when entries first become available for purchase and closes on the date published on the campaign page. The closing date will be announced on the campaign page and by email to everyone who has entered, at least seven (7) days before entries close. Entries submitted after the closing date and time are not eligible.
Entries are purchased through the Foundation's secure checkout. The following bundles are available:
| Bundle | Price | Entries |
|---|---|---|
| Rookie | $49.99 CAD | 500 |
| All-Star | $99.99 CAD | 1,250 |
| Hall of Fame | $149.99 CAD | 2,500 |
You may purchase more than one bundle. Entries from separate purchases are added together. Prices are in Canadian dollars.
Buying entries is a purchase, not a donation. No charitable tax receipt is issued for an entry purchase. A separate donation may be added at checkout, and that donation is receiptable.
Each entry is assigned its own number. Every entry carries the same weight in the Draw, whichever bundle it came from. Your entry numbers are sent to the email address given at checkout, usually within minutes. Keep that email. It is your record of entry.
If your confirmation does not arrive within twenty-four (24) hours, contact info@sparkcharity.ca before the closing date. The Foundation is not responsible for entries lost to an incorrect email address supplied at checkout.
One (1) grand prize: one (1) Home Run Jacket, one of only five produced. Approximate retail value $20,000 CAD.
The prize is awarded as described and cannot be exchanged for cash or any other item. The prize is not transferable before it is awarded. The prize is shipped to the winner's address in Canada, insured and at the Foundation's cost.
Only one of the five jackets is part of this Draw. The other four are not.
The jacket is awarded only if the reserve in section 7 is met. If it is not, section 7 applies instead.
The jacket is awarded only if gross entry sales reach $20,000 CAD by the close of the entry period (the "reserve"). Gross entry sales means the total paid for entry bundles during the entry period, not counting any separate donation added at checkout.
If gross entry sales are below the reserve when entries close, the Draw is not cancelled and entries are not refunded. The Draw is instead held as a fifty-fifty draw:
Every entry purchased carries the same weight in the Draw whichever outcome applies, and the draw is conducted the same way in both cases.
Whether the reserve has been met is determined from the Foundation's payment records at the moment entries close. The gross entry sales total and the resulting outcome are published on the campaign page alongside the result.
The winning entry is selected at random from all valid entry numbers issued during the entry period. The draw takes place after the entry period closes, at a time and place published on the campaign page, and is conducted in the presence of an independent witness who is not an entrant.
The decision on the winning entry is final.
The odds of any single entry winning depend on the total number of entries issued during the entry period. The total is not known until entries close. Because the number of entries issued is not capped in advance, odds cannot be stated before the Draw.
The winner is contacted using the email address and telephone number supplied at checkout, within five (5) business days of the draw. The winner must respond within fourteen (14) days of the first contact attempt and confirm eligibility.
If the winner cannot be reached within that period, declines the prize, or is found to be ineligible, the prize is forfeited and a replacement winner is drawn from the remaining valid entries.
The result is announced publicly on the Foundation's channels after the winner has been confirmed.
By accepting the prize, the winner agrees that their first name and city may be published in the announcement of the result. Any further use of the winner's name, likeness, photograph or statement for promotional purposes requires their separate written consent, and is not a condition of receiving the prize.
Entry purchases are final. If something went wrong with an order, contact info@sparkcharity.ca within five (5) days of purchase and the Foundation will look into it.
Proceeds support the work of the Spark Charity Foundation. The costs of producing the prize and running the campaign are met first. Where section 7 applies, the Foundation retains fifty percent (50%) of gross entry sales and the balance is paid to the winner. A summary of the amount raised is published after the Draw closes.
Information supplied at checkout is used to administer the Draw, deliver entry confirmations, contact the winner and meet the Foundation's record-keeping obligations. It is handled in line with the Foundation's Privacy Policy. It is not sold.
To the extent permitted by law, the Foundation is not liable for entries that are not received or recorded because of a network, hardware, software or payment processor failure outside its control, nor for any loss arising from use of the prize once it has been delivered.
Nothing in these rules limits any liability that cannot be limited by law.
If the Draw cannot be run as described because of circumstances outside the Foundation's reasonable control, the Foundation may amend these rules or cancel the Draw. Any change is published on this page with an updated date. If the Draw is cancelled before the winning entry is selected, entry purchases are refunded in full.
These rules are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes are subject to the exclusive jurisdiction of the courts of Ontario.
